Drinking on a party bus in Texas, the actual rule

Texas Penal Code 49.031 makes an open container in a vehicle's passenger area a Class C misdemeanor, then excepts a passenger in a vehicle "designed, maintained, or used primarily for the transportation of persons for compensation," naming buses and limousines.

Passengers are excepted. The chauffeur is not.
Texas has no statewide BYOB restriction, so bring what you plan to drink.
